May 2008: Arrested and charged with simple assault. Downey was involved in an argument with another student and allegedly threatened to hit him. The student initially did not press charges, but changed his mind ten days later when he found out that Downey was telling what he considered to be false stories about the incident. Charge dismissed a month later.
